How Do I Revoke My Power of Attorney
Property Powers of Attorney are very helpful tools in estate planning. If you lose capacity to make decisions for yourself, or even immediately if you choose, you can name someone to step in and make financial decisions for yourself. This can prevent the need to appoint a Conservator in many cases.
However, sometimes things change… people do too. What if you want to cancel your Power of Attorney? It is actually pretty simple. You can revoke your Power of Attorney in writing in front of a Notary. If you gave out copies of your Power of Attorney, you should provide them a copy of this revocation. If you have not given out your Power of Attorney, you can destroy it – we recommend shredding. Alternatively, you can prepare and sign a new Power of Attorney that states you revoke all previous Powers of Attorney.
When should you change or update your Power of Attorney? Usually, Powers of Attorney name a spouse, close friend, or relative. If the relationship with those you named has changed, you should update the document. This is especially important if you have recently divorced or separated from your spouse. You should also update your Power of Attorney if one of your named agents is deceased, incapacitated, generally unavailable, or does not want to serve anymore.
